Compatriots, parents of minor children, are informed that starting from 14th June 2023 it will no longer be necessary to present the other parent’s consent for the purpose of issuing their identity document<\/span> (passport and CIE), pursuant to<\/span><\/span> D.L.<\/span><\/span> 69\/2023.<\/span><\/span> <\/span><\/div>\n

Specifically, the new article 3-bis of Law 1185\/1967 indicates that, when there is a concrete and current danger that due to the transfer abroad, the latter may avoid fulfilling his obligations towards his children, it will be possible for the<\/span><\/span> other parent to request an injunction to issue the document.<\/span><\/span> The application can be presented to the competent judge at the ordinary Court in which the minor has his habitual residence or, if the minor is resident abroad, the Court in whose district the Municipality of AIRE registration is located.<\/span><\/span> <\/span><\/div>\n

For the purposes of issuing documents for minors<\/span><\/span><\/span>, the obligation remains for the consent signed by both parents or by those who exercise parental responsibility.<\/span><\/span><\/span><\/span><\/div>\n
